Man Gets Two And A Half Years In Prison For Having Sex On Beach

A Florida man must spend over two years in jail and register as a sex offender for having sex on a beach in broad daylight.

In July 2014, 40-year-old Jose Caballero and girlfriend, Elissa Alvarez, 21, were videotaped having sex in front of several children and adults on a beach in Manatee County, Florida.

A 4-year-old girl even allegedly asked her mother about what those two people were doing.

According to The Washington Post, Caballero claimed Alvarez was merely performing some sort of dance while his defense attorney noted no one had actually seen their genitals.

Assistant State Attorney Anthony Dafonseca, however, pointed out Alvarez's bathing suit had clearly been adjusted for her partner's convenience.

During the trial, he said,

It's insulting your intelligence to say that she was dancing.

Two months ago, they were each charged with two counts of lewd and lascivious behavior.

The State Attorney's Office first threatened to put the two in jail for 15 years but eventually agreed to a plea deal for the sentences delivered last Monday.

Alvarez was sentenced to 60 days while Caballero will face two and a half years in prison, and both will have to register as sex offenders.

The Washington Post reports Caballero's sentence would likely have been much lighter if he hadn't previously been convicted of drug trafficking.

As per the conviction, the couple will be prohibited from living near a school, park, daycare or playground.

Alvarez reportedly appealed her conviction, and Caballero will soon be doing the same.

The latter's prison time, should it withstand the appeal, will apparently cost the state of Florida over $45,000.
